These Terms of Service govern your access to and use of PokeDAQ, including the terminal, website, APIs, and all related services. By creating an account or using PokeDAQ, you agree to be bound by these terms. If you do not agree, do not use the service.
§ 01
Not financial advice
- —PokeDAQ is an information and portfolio tracking tool. Prices, indices, charts, sector composites, and all other market data displayed on the terminal are for informational purposes only.
- —Nothing on PokeDAQ constitutes investment advice, a buy or sell recommendation, or a guarantee of any price or return. Pokemon card markets are volatile, illiquid, and subject to rapid change.
- —You are solely responsible for your trading and collecting decisions. PokeDAQ is not a broker, dealer, exchange, or financial advisor.
§ 02
Acceptable use
- —Do not scrape, crawl, or programmatically access PokeDAQ beyond published API rate limits.
- —Do not resell, redistribute, or sublicense market data, indices, or analytics without a separate commercial license.
- —Do not attempt to manipulate data feeds, submit fake trade data, or interfere with the integrity of pricing information.
- —Do not use PokeDAQ for money laundering, fraud, or any illegal activity.
- —Do not share your account credentials with others or allow multiple people to use a single account.
- —Do not reverse-engineer, decompile, or attempt to extract the source code of any PokeDAQ software or service.
§ 03
Accounts
- —One account per person. You are responsible for all activity that occurs under your credentials.
- —Keep your password secure. Use a strong, unique password and enable any available security features.
- —Notify us immediately at security@pokedaq.app if you suspect unauthorized access to your account.
- —We may suspend or terminate accounts that violate these terms, with notice where practicable.
§ 04
Intellectual property
- —PokeDAQ owns the terminal interface, indices (including PDQ100), analytics, and all original content and software.
- —Pokemon is a trademark of Nintendo / Creatures Inc. / GAME FREAK inc. / The Pokemon Company. Card images are sourced from pokemontcg.io under their terms. We claim no ownership of Pokemon intellectual property.
- —Portfolio data, watchlists, and other content you create within PokeDAQ remains yours. You grant us a limited license to store, process, and display it back to you as part of the service.
§ 05
Subscriptions and billing
- —Retail (free) accounts have limited features as described on the pricing page. No payment information is required.
- —Pro and Desk subscriptions auto-renew monthly or annually until cancelled. You can cancel at any time from Profile > Plan & Billing.
- —First-time Pro subscribers: 7-day money-back guarantee from date of initial purchase.
- —Annual plans: 14-day pro-rated refund window from date of purchase or renewal.
- —No refunds are issued after the applicable refund window has closed. Partial-month refunds are not provided for mid-cycle cancellations; your access continues until the end of the paid period.
§ 06
Limitation of liability
- —PokeDAQ is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
- —We are not liable for: trading or investment losses, missed or delayed alerts, inaccuracies in price or market data, service downtime or interruptions, failures of third-party services (Stripe, Cloudflare, data providers).
- —Our maximum aggregate liability to you for any claims arising from your use of PokeDAQ is limited to the total amount you paid us in the 12 months immediately preceding the event giving rise to the claim.
§ 07
Indemnification
- —You agree to indemnify, defend, and hold harmless PokeDAQ and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these terms, or your violation of any rights of a third party.
§ 08
Termination
- —We may suspend or terminate your account for violations of these terms, with notice where practicable. Serious or repeated violations may result in immediate termination without notice.
- —You may delete your account at any time from Profile > Security. Upon deletion, your data is handled according to the retention schedule described in our Privacy Policy.
- —Sections that by their nature should survive termination (liability, indemnification, intellectual property, governing law) will survive.
§ 09
Governing law and disputes
- —These terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles.
- —Any disputes arising from these terms or your use of PokeDAQ shall be resolved exclusively in the state or federal courts located in New York County, New York.
§ 10
Changes to these terms
- —We may update these Terms of Service from time to time. Material changes will be communicated via email to all registered users at least 30 days before taking effect.
- —Continued use of PokeDAQ after the effective date of revised terms constitutes acceptance of the updated terms.
- —The "Last updated" date at the top of this page reflects the most recent revision.
